I have adapted the Kzero12 Beach Camps Terms of Service to better reflect a business that offers both physical products and athletic services (camps).

The key changes focus on Section 2 (Services) and Section 16 (Liability) to ensure you are protected against the physical risks inherent in sports training, while maintaining the Shopify-specific language required for your store.

Welcome to Kzero12 Beach Camps! The terms “we”, “us” and “our” refer to Kzero12 Beach Camps. We operate this store and website, including all related information, content, and athletic services (the “Services”). Kzero12 Beach Camps is powered by Shopify, which enables us to provide the Services to you.

By visiting our site or purchasing a camp registration or physical product, you agree to be bound by these Terms of Service.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. If you are registering a minor for a camp, you represent that you are their legal parent or guardian and consent to their participation in our Services.

SECTION 2 - PRODUCTS AND ATHLETIC SERVICES

  • Accuracy: We strive for accuracy in describing our gear and camp curriculums. However, we do not warrant that the quality of any products, services, or information purchased will meet your personal expectations.

  • Camp Variations: We reserve the right to modify camp schedules, coaches, or locations due to weather, attendance, or unforeseen circumstances.

  • Health & Safety: Participation in beach volleyball camps requires physical exertion. By purchasing a service, you represent that the participant is in good health and has no medical conditions that would make participation unsafe.

SECTION 3 - ORDERS AND REGISTRATIONS

When you place an order or book a camp spot, you are making an offer to purchase. Kzero12 Beach Camps reserves the right to decline any order.

  • Personal Use: Purchases are for personal use or for your designated dependents and are not for commercial resale.

  • Refunds: Physical goods and camp registrations are subject to return or cancellation solely in accordance with our [LINK TO REFUND POLICY].

SECTION 4 - PRICES AND BILLING

Prices for our camps and gear are subject to change without notice. We reserve the right to modify or discontinue a Service at any time. You agree to provide current, complete, and accurate purchase and account information for all transactions.

SECTION 5 - SHIPPING AND RISK OF LOSS

For physical merchandise, title and risk of loss pass to you once we transfer the products to the carrier. We are not liable for shipping delays caused by carriers or customs.

SECTION 6 - INTELLECTUAL PROPERTY

All content, including the Kzero12 Beach Camps name, logos, training methodologies, and website media, are the property of Kzero12 Beach Camps and are protected by intellectual property laws. You may not use our branding or training materials for commercial purposes without prior written consent.

SECTION 7 - RELATIONSHIP WITH SHOPIFY

Kzero12 Beach Camps is powered by Shopify. You acknowledge that Shopify is a platform provider and is not responsible for the actual sale, delivery, or conduct of our beach volleyball camps. You release Shopify from all liability related to your transactions with us.

SECTION 8 - INHERENT RISKS AND LIMITATION OF LIABILITY

PLEASE READ CAREFULLY: * Physical Activity: You acknowledge that beach volleyball involves inherent risks of injury, including but not limited to heat exhaustion, sprains, or contact with other players/equipment. By registering for a camp, you voluntarily assume all risks associated with participation.

  • Limitation: To the fullest extent provided by law, Kzero12 Beach Camps, our coaches, and employees shall not be liable for any injury, loss, or claim arising from your use of the Services or any products procured through the store. Our liability shall be limited to the maximum extent permitted by law in your jurisdiction.

SECTION 9 - INDEMNIFICATION

You agree to indemnify and hold harmless Kzero12 Beach Camps and our team from any claim or demand, including reasonable attorneys’ fees, made by any third party due to your breach of these Terms or your violation of any law or the rights of a third party during our camps.

SECTION 10 - SEVERABILITY AND TERMINATION

If any provision of these Terms is determined to be unlawful or void, the remaining provisions shall remain in full force. We may terminate this agreement or your access to our camps at any time if we determine you have violated these Terms or engaged in prohibited conduct on the court.

SECTION 11 - GOVERNING LAW

These Terms of Service and any agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the jurisdiction where Kzero12 Beach Camps is headquartered.
